Terms and conditions


Please read these terms and conditions carefully. You will be legally bound by these Terms from the time you submit an entry for the Tarmac Electric Mixer Design Competition (Competition).

The Promoter; is Tarmac Trading Limited (Tarmac), Portland House Bickenhill Lane, Solihull, Birmingham, B37 7BQ

How to enter:

1. The Competition will open at 00:00 BST on 27th July 2022 and close at 23:59 BST on 5th August 2022.
2. All entries received after 23.59 BST on 05/08/2022 are automatically disqualified.
3. To enter the competition, entrants need to use the design template supplied to create a drawing based on the theme of sustainability and/or construction to be in with a chance of featuring on the drum of its brand-new battery electric concrete mixer
4. Entries can only be made by email or post:
4.1 To enter via email, the Parent/Guardian will need to download the design template  and send entries by email to community@tarmac.com including the artist’s name, age and the Parent/Guardian contact details.
4.2 To enter via post, the Parent/Guardian will need to print the design template, insert the artist’s name, age and the Parent/Guardian contact details and post it to E-mixer Design Competition, Portland House, Bickenhill Lane, Solihull, B37.
5. Entries must not contain material that:
5.1 is inappropriate, offensive, indecent, obscene, hateful, defamatory, derogatory or anything similar;
5.2 promotes irresponsible or excessive drinking; or
5.3 may promote bigotry, racism, hatred or harm against any group or individual or that may promote discrimination based on race, gender, religion, nationality, disability, sexual orientation or age.
6. Entrants acknowledge that other entrants may have submitted ideas and concepts that may be similar to their entry, and that they will not be entitled to any compensation or right to negotiate with the Promoter over such matters.
7. Entrants warrant that their entries are their own original creation and have not been copied and/or reposted from any other persons.
8. In the event of any dispute regarding the winner, the decision of the Promoter is final and no correspondence or discussion shall be entered into.
9. The Promoter reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of these terms and conditions.
10. The Promoter is not responsible for any lost, late, incomplete, invalid, unintelligible or misdirected entries, which will be disqualified. No responsibility can be accepted for any technical failures of any kind or any unauthorised intervention in any part of the entry process, nor for any technical or human error, which may occur in the administration of this competition or the processing of entries.

Eligibility:

11. The Competition is open to children aged five to 12 who are residents of Great Britain the Isle of Man and the Channel Islands. The competition is open to the public, including employees of the Promoter, and their families, providing there is no indication included within the entry that is intended to specifically refer to or indicate to the judges that they are so connected to the Promoter (this does not include the entrants name and address which is essential for entering the competition).
12. Parent/Guardian permission is to be sought before entering the competition. The Parent/Guardian is to submit entries to the competition on their child’s behalf.
13. In entering the competition, you confirm that you are eligible to do so. The Promoter may require you to provide proof that you are eligible to enter the competition. The Promoter reserves the right to verify entrants’ eligibility.
14. There is a limit of one entry to the competition per person. Multiple entries or entries made through agents, third parties, organised groups or any entry duplication method will not be accepted. Multiple entries per household will be accepted from alternate entrants i.e., siblings.
15. The Promoter will not accept competition entries that are:
15.1 automatically generated by computer;
15.2 completed by third parties or in bulk; or
15.3 illegible, have been altered, reconstructed, forged or copied;

Prize:

16. One winner (the “Winner“) and two runners up (the “Runners Up“) will be selected from all valid entries and will each receive a prize of art supply bundles; including (but not limited to): paints, pencils, crayons, brushes, and paper. The winner will also be invited to visit the Tarmac Washwood Heath site to sit in the cab of the vehicle, and will have their design transferred to the drum of the electric mixer.
17. The Winner/Runners Up of the competition will be notified within seven days by either telephone/email/post using the contact details provided on the entry form.
18. The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize with 14 days, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the valid entries received before the closing date.
19. Prizes will be delivered by post to the address specified by the Winner/Runners Up.
20. The prizes are non-transferable and non-refundable. There is no cash alternative to the prizes. Tarmac reserves the right (but is not obliged) to substitute a reasonably equivalent alternative prize, of equal or greater value, should circumstances make this necessary.

Judging:

21. The Winner/Runners Up will be selected by a judging panel made up of industry experts from the across Tarmac business. The top three designs will be selected by the panel based on their views on which designs best reflect the theme of sustainability and/or construction, as well as the suitability of the selected design to be transferred to the mixer drum. The panel will vote on the top three most appropriate designs where one winner and two runners up will then be selected.
22. The decision of the panel of judges (acting reasonably) will be final.
23. The Promoter will send a list of names of the judges can be viewed on its website at https://tarmac.com/news/tarmac-launches-childrens-art-e-tack-competition-to-design-uks-first-electric-concrete-mixer/ from the closing date for a period of 14 days.
24. The Promoter will [publish the surname and county of major prize winners and, if applicable, their winning entries on its website at https://tarmac.com/news/tarmac-launches-childrens-art-e-tack-competition-to-design-uks-first-electric-concrete-mixer/
25. If you object to any or all of your surname, county and winning entry being published or made available, you should contact the Promoter at pr@tarmac.com In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

Ownership and publication of competition entries and intellectual property rights:

26. The Winners/Runners Up may be required to take part in publicity accompanying or resulting from this competition. By entering this prize draw you hereby assign to the Promoter, and waive your moral rights in, the copyright and all other intellectual property rights whatsoever in your entry and confirm that you have no rights in any promotional or advertising material or similar which arises out of, or is in connection, with this prize draw.

Data protection and publicity:

27. Insofar as the Promotor becomes a controller of any personal data relating to entrants, any such personal data will be held and/or processed in accordance with current UK data protection legislation and for the purposes of the current competition only. The details of the Promotor’s privacy policy including details on how to exercise any rights under the data protection legislation can be found at Annex 1.
28. Subject to clause 25 above, no personal data of entrants held and/or processed by the Promotor will be disclosed to a third party without the data subject’s prior consent, other than is absolutely necessary so as to fulfil the terms of the competition, in which case such processing will be subject to the necessary lawful basis under data protection legislation.
29. You should not submit any personal data that is not personal to and/or relates specifically to you. You hereby warrant that the information which you submit and/or distribute will not infringe the intellectual property or any other rights of any third party, and will not contain anything which is defamatory, obscene, indecent, harassing or threatening.
30. By entering this competition, you hereby warrant that all information submitted by you is true, current and complete.
31. By entering the competition, entrants agree to taking part in promotional activity for the electric mixer. This includes giving Tarmac permission to take photographs and or videos of their child/children (if more than one of their children wins or is runner up) and therefore grant Tarmac full rights to using the images and/or videos for publicity purposes to help achieve Tarmac’s aims for the competition and overall promotion. This might include (but is not limited to), the right to use them in their printed and online publicity, social media, press releases and future competitions.

General:

32. The Promoter reserves the right, at its sole discretion, to disqualify any entry that does comply with these terms and conditions.
33. The Promoter reserves the right to amend or withdraw this promotion if circumstances arise which are beyond its control.
34. The Promoter reserves the right to disqualify any individual it finds to be tampering with the operation of the competition or in an unsportsmanlike or disruptive manner. Any attempt by any person deliberately to undermine the legitimate operation of the competition may be a violation of criminal and civil law and, should such an attempt be made, the Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. The Promoter’s failure to enforce any of these terms and conditions shall not constitute a waiver of that provision.
35. Except where prohibited, entrants agree that:
35.1 any and all claims brought by them in relation to this competition, and any consequential judgments or awards, shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this competition and
35.2 under no circumstances will entrants be permitted to obtain awards for, and entrants hereby waive all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and all rights to have damages otherwise increased. Subject to any liability arising as a result of its fraud or fraudulent misrepresentation, the Promoter’s liability for claims related to this promotion is limited to a maximum of three thousand pounds.
36. To the extent permitted by law, the Promoter is not liable for any injury or damage to persons or property, which may be caused, directly or indirectly, from any entrant’s participation in the competition or from any prize.
37. All issues and questions (whether contractual or non-contractual) concerning the construction, validity, interpretation and enforceability of these terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties hereby agree to the exclusive jurisdiction of the English courts.
38. The Competition and these terms and conditions are subject to English law. Any disputes must be referred to the English courts.

Your personal information is important. Tarmac is committed to doing its part to protect your personal information.

It is important that you read this Privacy Notice because it tells you how and why we are using your personal information when you enter the Art-E-Tack competition (the “Competition”). We collect personal information that you provide when you enter the Competition. In this case, the personal information we collect is: (i) the artist’s name; (ii) the artist’s age; and (iii) the artist’s contact details (including email and postal addresses which were used to enter the Competition).

We use this information to run the Competition. Our lawful basis for processing this personal information is our legitimate interest in running the Competition.

Disclosures of your Personal Data

We will not share your personal information to third parties, except in the following cases:

  • Where we choose to sell, transfer or merge parts of our business or our assets.
  • To advisers who provide professional services to us.
  • To regulators and other authorities.

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed.

Data Retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To decide how long to keep your personal information for, we consider things like the volume and sensitivity of the information, as well as the risk to you if the information were mis-used, as well as what the law tells us to do.
